SC allows ex-judge Fazlul Haque's plea in graft case

The Appellate Division of the Supreme Court (SC) on Monday allowed former adviser of the caretaker government Justice Fazlul Haque to file an appeal against the High Court order that cleared way to try him in a graft case.

"Leave on additional grounds," said a three-member apex court bench headed by Chief Justice Surendra Kumar Sinha.

"The Supreme Court allowed the leave to appeal plea and also stayed the proceedings of the case," advocate Khurshid Alam Khan, counsel for Anti-Corruption Commission (ACC), told newsmen.

The High Court on March 15, 2017, dismissed Justice Haque's plea challenging the proceedings of the case filed by ACC. The former adviser of the caretaker government then filed the leave to appeal plea with the apex court.

According to the case documents, the concerned trial court had framed charges against Justice Haque in the case on November 14, 2016.

"The ACC had filed the case on April 13, 2008, against him for concealing information about the wealth worth around Taka 97 lakh. The graft body in its investigation found that he has accumulated wealth of Taka 1.80 crore in illegal ways. The trial court is now examining witnesses in the case," advocate Khan said earlier.
