Bidisha appeals against sentence, bail plea rejected

Former president H.M. Ershad’s former wife Bidisha Siddiq has appealed against her two-year jail sentence in a fraud case over the sale of a flat, but a Dhaka court has rejected her bail petition.

Dhaka Metropolitan Sessions Judge Md Shahjahan Kabir rejected the bail plea on Wednesday after admitting her appeal.

Defence lawyer Md Mahmudul Kabir said they sought bail citing Bidisha’s gender and the fact that she has a child with special needs. The court, however, found insufficient grounds to grant bail. The defence plans to move the High Court against the order.

On May 20, Metropolitan Magistrate Md Jamsed Alam sentenced Bidisha to two years in jail and fined her Tk10,000, with an additional month in jail in default.

She was arrested from a restaurant in the capital on August 25 and sent to jail the following day after her bail was rejected.

The case, filed in February 2008 by businessman Mosharraf Hossain, alleges that Bidisha agreed to sell him a flat at President Park in Baridhara for Tk80 lakh in 2001. He paid Tk75 lakh through a pay order, but the flat was allegedly never handed over.

The complainant said Bidisha later issued a Tk72 lakh cheque to refund the money, but it was dishonoured due to insufficient funds. He also alleged that repeated demands for the money or the flat were met with delays and threats.
