The Supreme Court's Appellate Division has stayed a High Court order that declared the Election Commission's gazette on the boundary change of the Cumilla-2 constituency illegal.
The Appellate Division bench, led by Chief Justice Zubayer Rahman Chowdhury, issued the order on Tuesday granting leave to appeal against the High Court ruling.
As a result, the election in Cumilla-2 will be held under the redrawn boundary set by the Election Commission.
Homna and Titas will together form the Cumilla-2 constituency.
During the 12th parliamentary election, Cumilla-2 consisted of the Homna and Meghna Upazilas. However, for the upcoming election, the Election Commission revised the boundaries on September 4, last year, defining the constituency with Homna and Titas upazilas.
Homna Upazila BNP President Mohammad Mohiuddin filed a writ petition with the High Court challenging the decision.
Following a preliminary hearing, the High Court issued a rule on September 17 last year. After concluding the final hearing, the court delivered its verdict on January 8 this year, making the rule absolute and restoring the previous boundaries of the Cumilla-2 constituency.
It was then challenged at the Appellate Division, which reinstated the new boundaries on Tuesday.
