Attorney General Md Asaduzzaman has said that under the Constitution, he can contest the upcoming national election without resigning from his current position.
He made the remarks while speaking to reporters at his office on Thursday (November 6), following the Appellate Division’s hearing on the caretaker government system.
Asaduzzaman explained that the Attorney General is not a government employee but a constitutional lawyer for the state as per Article 64 of the Constitution. “This is not a government service post. An Attorney General may contest elections with or without resigning — this is an established principle,” he said.
“In my official capacity, I am the Attorney General of the state,” he added.
Responding to journalists’ comments that the Attorney General is expected to remain neutral, Asaduzzaman said, “The Attorney General represents the state. If the Attorney General believes that any government action is unjustified or harmful to the state, he has the right to oppose it — that is the rule of law.”
He further stated, “One can contest elections while holding the post — there is no legal bar to that.”
The Attorney General also claimed that some media reports on Wednesday (November 5) had misrepresented his comments about participating in the election.
