How to get a trade license

A trade license in Bangladesh is a significant certificate for an individual or organization interested in conducting business operations. From opening a new outlet to the formation of a manufacturing unit, to the provision of a service, obtaining a trade license is a mandatory requirement as per the law that enables the business to be legally operating and as per the rules of the government. Apart from rendering the business legally recognized, it also adds validity and authenticity to the operations.

A trade license is an official document that the municipal board or local city corporation of Bangladesh issues. It is obligatory for every individual, firm, or organization intending to carry out any business activity whatsoever. The license is granted after scrutiny of the nature and extent of operations to ensure that the business complies with the local legislation, zoning ordinances, and health and safety requirements. Trade license is a permit for carrying on particular business activities and is required to operate businesses in a legal way. Whether a small, medium, or big business, illicit businesses that fail to have a trade license risk being fined, for instance, or closed by local authorities.

To get a trade license, the applicant must fulfill certain eligibilities as mentioned by the local government. These conditions vary somewhat from municipality or city corporation but always tend to include some important ones. The applicant has to be 18 years and above to be able to conduct business in Bangladesh. This ensures the applicant is an adult and capable of signing contracts and holding responsibility for operating the business. A national identification card or a valid passport is also needed to prove the applicant's identity. This will make sure that the applicant is either a Bangladeshi citizen or a foreigner residing lawfully in the country. The nature of business should also be legal under Bangladeshi law. Any kind of business, whether retail, manufacturing, or services, may have special conditions or licenses that must be obtained before applying for a trade license.

The business must also have premises from which it will conduct its operations. This may be a business office, shop, or factory. The premises must meet zoning and safety standards. Potential applicants are likely to be required to submit ownership or tenancy documents of the premises in order to ensure that the business is located in an appropriate place for the type of business being conducted. It is also necessary that the applicant is a registered taxpayer with the National Board of Revenue (NBR) or has been issued an electronic Taxpayer Identification Number (e-TIN). This is to guarantee that the business complies with tax regulations and contributes to the revenue system of the country.

Getting a trade license in Bangladesh is not that complex, although it requires one to pay strict attention to detail and comply with local regulations. The first thing is to determine the nature of business to be conducted. Different businesses may have different licenses. For example, a retail shop, a food processing unit, and a construction company each have different licenses. Once the type of business is selected, the application form is prepared to the municipality office or city corporation of the locality, filling up details about the name of the business, kind of business, business address, and owner details. In addition to the application, supporting papers such as a photocopy of e-TIN certificate, proof of owner/tenancy, and passport photocopy or national identity card have to be submitted as well.

 

 


Besides the filing of the application, the applicant must remit the fees payable. The fee for a trade license is determined by the type of business, size of operation, and area. It tends to be determined by the city corporation or municipality. In some cases, the fee may be paid for one year and in some other cases, it may be a one-time lump sum payment. After payment and submission, the local authorities will typically visit the business premises to verify compliance with zoning laws, health and safety requirements, and other local regulations. The premises must meet the safety requirements of the concerned authorities. Companies in industries such as food processing, manufacturing, or others regulated by the government may require special licenses or certifications.

After reviewing the application, and upon completion of the inspection, the municipal office or city corporation shall grant the trade license. The license shall generally be valid for a year and needs to be renewed each year. It needs to be kept visibly displayed at the place of business. Not only is a trade license legally mandatory but has several vital functions to serve. It promotes compliance with Bangladesh's legal structure. Operating without a license can attract penalties, fines, and business closure. Obtaining a trade license also promotes consumer confidence since customers prefer dealing with licensed companies as it ensures that they are operating legally and ethically. Additionally, a trade license confirms that the company is registered with the tax authorities, making tax collection easier and enabling businesses to contribute to the nation's economic development.

A trade license also provides legal cover to enterprises as it entitles them to the legal safeguards that exist under Bangladeshi laws. These are immunity against forgery and the right to sue in case of a grievance. A trade license is a prerequisite for enterprises looking to expand or desire investment. Banks and investors would prefer to transact with legally registered and compliant enterprises.

Trade licenses typically remain valid for one year and must be renewed annually. Renewal involves making application to the local authorities, accompanied by proof of continued trading and payment of applicable fees. Failure to renew within time can attract imposition of penalties and, in extreme cases, shut down of the business. It is therefore advisable for owners of businesses to keep track of the renewal date to avoid paying penalties and putting the business in legal standing.

It is a procedure that is needed by anyone who wants to open a business. It makes sure that the business is compliant in terms of obeying local regulations, provides protection under the law, and adds a touch of legitimacy to it. With procedures in place and by meeting the eligibility conditions, businesses can legally and boldly conduct business and contribute to the development of the economy in the country. For small and big businesses, the trade license is a success pillar in Bangladesh's competitive business environment.
