HC reprimands Cox's Bazar DC for not removing illegal establishment from sea beach

The High Court (HC) on Wednesday severely reprimanded Cox's Bazar Deputy Commissioner (DC) Mamunur Rashid for not complying with its earlier order regarding the eviction of illegal structures built on the largest sea beach area of the world.
 "Your performance in protecting the beauty of Cox's Bazar is not only zero but also negative. You have not implemented the highest court orders despite repeated reminding. Failure to obey the court order will end your career. You should not take the risk," the HC bench comprising Justice JBM Hasan and Justice Razik Al Jalil came up with the observations while hearing on a petition filed by DC of Cox's Bazar seeking unconditional apology to the court for not complying with its order regarding the eviction of illegal structures on the beach.
However, the HC bench exempted the DC from personal appearance and ordered him to vacate the illegal constructions built on the sea beach area by October 31 and submit a report in this regard by November 9.
Pointing the finger to advocate Momtaz Uddin Fakir, counsel for the DC of Cox's Bazar, the HC bench said that it never insulted anyone and the court has been given many opportunities for DC.
"We asked Deputy Attorney General to convey the court orders and the state lawyer informed him of the court's attitude. However, the DC did not obey the higher court order. That's why the court asked him to appear before it," the court added.
Later the court advised the DC saying that Cox's Bazar is known to people all over the world. You are the DC of Cox's Bazar. Play a role in protecting the beauty of Cox's Bazar. People around the world will know you.
"We are not asking to throw them in the Bay of Bengal by evicting them. You manage it beautifully. People will remember you. We open newspaper-TV every day to see what you are doing. But your performance is neither zero nor negative," the HC bench said.
At that time, the DC told the court that he has evicted some illegal structures in the meantime. But, now I will obey the court order and implement its all order, which will upon on me.
Earlier in the morning, Cox's Bazar Deputy Commissioner appeared before the HC as per its earlier directive.
On August 25, the HC bench summoned the deputy commissioner of Cox's Bazar district for not implementing its earlier order to remove all illegal encroachments from the largest sea beach.
The HC bench also issued a contempt of court rule against four others, including Cox's Bazar Development Authority Chairman Lieutenant Colonel Forkan Ahmad (retired), asking the authorities concerned as to why contempt court proceedings should not be drawn and no action should be taken against them for violating the High Court order.
The three other accused in the case are Cox's Bazar Mayor Mujibur Rahman, deputy town planner Tanvir Hasan and SP Hasanuzzaman.
The HC on June 7, 2011 directed the officials to evict illegal structures from Jhilonja, Sugondha and Laboni areas of Cox's Bazar sea beach.
