Delay in postin girks judges

Despite availability of a panel of judges to fill over 50 vacant posts of senior assistant to district judges, the posts are still vacant resulting in disappointment among the judicial officers.

According to the Law Ministry sources, a total of 22 posts of district judges, 13 posts of additional district judges and 10 posts of joint district judges are vacant. Apart from this, more than 15 posts of Senior Assistant Judges are also vacant.
 
Against these vacant posts, the Law Ministry recommended to elevate 29 judges from Additional District Judges to District Judges, 64 Joint District Judges to Additional District Judges and 6 Senior Assistant Judges to Joint District Judges.
 
Law Secretary Golam Sarwar said the issue of vacancy and promotion is an ongoing process. The process of filling up the vacant posts through promotion is under process. But the number of vacant posts is also not much.

According to the Bangladesh Judicial Service Rules, 2007, for promotion to the post of Senior Assistant Judge, Assistant Judges have to fulfil the condition of serving in this post for four years. Senior Assistant Judges are required to complete two years of experience for promotion to the post of Joint District Judge, two years for promotion from Joint District Judge to Additional District Judge and two years for promotion from Additional District Judge to District Judge.

Sources said the panel for promotion of judges to the rank of Joint District Judge and Additional District Judge who fulfilled the experience criteria was held in 2019. Although many of them have already been promoted, 93 have not been promoted even after five years.

On the condition of anonymity, some of these judges expressed their frustration and anger and said they have not yet been promoted to the next level despite the promotion panel.

In the case of Judges, Government Orders of Promotion (GO) are issued from time to time subject to vacancies. Although there are no vacancies in the administration cadre and other services, the promotion order of all panels are issued by the concerned ministries.

Sources said all ministries have departmental promotion committees for promotions. After the committee finalises the promotion panel, it goes to the Presidents office via the Prime Ministers office. If the President approves, the promotion GO of all panel is issued on the same day. However, in the case of judges, if the committee finalises the panel, it is sent to the Supreme Court. After getting consent from the Supreme Court, the Law Ministry takes the next course of action to elevate the judges.
