Three get life term for death of two students
Two drivers and a helper of Jabal-e-Noor Paribahan were sentenced to life term imprisonment for the death of two students of Shaheed Ramizuddin Cantonment College, Dia Khanam Mim and Abdul Karim Rajib.
Judge KM Emrul Kayesh of Dhaka Metropolitan Sessions Judge Court pronounced the judgement in a crowded court room in presence of two convicts -- drivers Masum Billah and Zobair Hossain Sumon. Another convict Kazi Asad, helper of one of the two buses, was on the run.
The court fined Tk 50,000 each in default, to suffer six months more imprisonment.
However, the court acquitted one of the bus owners Jahangir Alam and the helper of another bus Enayet Hossain as the prosecution failed to prove the charges against them beyond doubt.
On July 29 in 2018, Dia and Rajib were killed when two buses of Jabal-e-Noor Paribahan ploughed through a crowd in a mad race of competing in front of Kurmitola General Hospital on the Airport Road in the capital.
Metropolitan Session Judge Court in Dhaka fixed Sunday for delivery of the judgement in the sensational case after completion of arguments of both sides on November 14.
On September 6, inspector Kazi Shariful Islam of
the Detective Branch of Police, also investigation Officer (IO) of the case submitted charge sheet to the Chief Metropolitan Magistrate Court of Dhaka against two bus drivers, two helpers and two owners of Jabal-e-Noor Paribahan.
The charge sheeted accused are Jabal-e-Noor Paribahan owners, Md Shahadat Hossain, Md Jahangir Alam, drivers, Md Masum Billah, Md Jobayer Shumon and helpers, Md Enayet Hossain, Asad Gazi.
The part of Md Shahadat Hossain was stayed by the High Court in an order. Due to high court's stay order, the trial court disposed the trial of the five accused.
On October 25 the trail court framed charges against six accused under Sections 279, 323, 325,304 and Section 34 of the penal code.
Of the six accused, four are now in jail while Kazi Asad and Jahangir Alam are on the run. Among the accused, Masum Billah and Shahadat Hossain gave confessional statements to the court.
A total of 37 out of 41 prosecution witnesses gave depositions before the court in the case.
Forty one people were made witnesses in the charge-sheet which said drivers of the two buses of Jabal-e-Noor Paribahan were in competition to get more passengers and drove recklessly and ploughed through people waiting on the pavement.
On July 20, Jahangir Alam, father of Mim, filed the case with the Cantonment Police Station following the deaths of his daughter and one other Rajib.
Public prosecutor Abdullah Abu and Additional Public Prosecutor Taposh Kumar Paul conducted the case for the state. Driver Masum Billah's lawyer Adv Hashimuddin told this correspondent that for controlling student's movements Section 304 was included in the case. No neutral witnesses gave deposition.
The punishment was given on the basis of confessional statements.The confessional statements were fabricated. The punishment will not hold in higher court. Accused Zobair Hossain Sumon's lawyer Adv TM Asadul Haque in a reaction said that they are aggrieved. He would go to the higher court.
