No need for ASK to vacate Lalmatia office: HC

The High Court on Sunday stayed issued a status quo for three months on a Rajuk mobile court order asking rights body Ain O Salish Kendra (ASK) to vacate its Lalmatia office.

The HC bench of Justice M Enayetur Rahim and Justice Md Mostafizur Rahman came up with the order following a petition filed by ASK.

It also issued a rule asking the authorities concerned to explain as to why the Tk 2 lakh fine imposed by the mobile court on the rights body should not be declared illegal, UNB reports.

Advocate ZI Khan Panna stood for ASK while Deputy Attorney General Amit Talukdar represented the state.

On November 14, a mobile court of Rajdhani Unnayan Kartripakkha (Rajuk) asked ASK to vacate its office within two months and fined it Tk 2 lakh.

On November 15, ASK Executive Director Sheepa Hafiza at a press briefing said the mobile court, led by its Executive Magistrate Jesmine Akhter, sought the reason behind operating their office in the residential area.

In reply, the ASK authorities said they were running their office by maintaining all the conditions as tenant. They also submitted all documents to the Rajuk, she said.

Sheepa Hafiza also said ASK has been working for protecting the human rights for the last 33 years after taking approval from the deputy commissioner concerned and Bangladesh NGO Bureau and it does not work for any financial or business purpose.

After knowing everything, the Rajuk mobile court fined Tk 2 lakh and asked it to vacate the office within two months according to the section 3 (ka) of the Building Construction Act 1952.

Later, the rights body filed a petition with the High Court challenging the Rajuk order.
