SC upholds additional tax as surcharge from rich

The Appellate Division of the Supreme Court on Thursday ruled that collection of additional tax as surcharge from the rich will not be stopped.
A five-member bench of the Appellate Division headed by Acting Chief Justice Md Abdul Wahhab Miah passed the order after hearing a leave to appeal petition filed by several businessmen challenging a High Court (HC) verdict.
The HC in a judgment in 2015 had declared that imposition of additional tax as surcharge for the wealthy people is constitutional.
But, the court granted the leave to appeal allowing the businessmen to file an appeal against the HC order with the Appellate Division, Deputy Attorney General Rashed S Jahangir told journalists.
The High Court (HC) on January 12 in 2016 passed a judgment declaring collection of additional tax as surcharge from the rich people is constitutional. Then, some businessmen filed a leave to appeal against the verdict.
Lawyer Fida M Kamal moved for the businessman while Deputy Attorney General Rashed Jahangir for the state.
National Board of Revenue (NBR) has been collecting surcharge from the persons with wealth of over Tk 2 crore in line with income tax ordinance. The surcharge had been restructured at four levels from the fiscal year 2015-2016.
